Beautifully furnished white water view beach front lower level unit on a private beach in an exclusive gate guarded community. The living area has a 42" HDTV and opens to an ocean view patio with a spa, gas barbeque and teak patio furniture. The two spacious bedrooms offer a California King bed, a full bed, and a bunk bed. In the living room is a queen size sleeper sofa. We also have a nice raised queen size inflatable bed.

This property was remodeled with new windows, doors, hardware, cape cod moldings/baseboard, new window coverings, carpeting, travertine floors, paint, granite countertops, appliances along with new furnishings.

Cancellation Policy

In the event of a cancellation of all or part of a reservation for a property by Guest or by Beach Road Realty for non-payment, Beach Road Realty agrees to refund, or transfer, the rental deposits to guests, or other owner, only in the event that the subject property is re-rented for the canceled period under substantially the same terms and conditions as included herein. In the event of the foregoing, a refund will be given less a 20% cancellation fee. Beach Road Realty and Guest shall make their respective best efforts to re-rent in the event of cancellation. It is understood by the parties, that should the owners of the property sell the property or otherwise remove it from the market and the owner will not honor the reservation, Beach Road Realty will use its best efforts to locate a like property at a similar price. If a property, satisfactory to Guest, in its sole discretion, cannot be made available, then all monies will be returned to the Guest. Guest agrees that Beach Road Realty will have no further obligation to the Guest. Traveller's Insurance is offered by various companies for your protection regarding cancellations due to sickness, etc.



Reservation Information

In order to make a reservation, please click on the Check Availability Calendar to make sure the property is available for the time period that you are seeking it for and have your credit card ready to make a deposit. Typically, your credit card will not be charged for the security deposit unless you make long distance telephone calls from the unit or the property has been damaged. Reservations less than 60 days in advance: If you are making a reservation less than 60 days (2 months) in advance, full payment will be due immediately. Reservations more than 60 days in advance: If you are making a reservation more than 60 days in advance, 1/2 of the the rental amount is due immediately and the balance within 60 days before your rental start date.

Dana Point was incorporated on January 1, 1989. The City's boundaries encompass the three distinct communities of Capistrano Beach, Dana Point, and Monarch Beach. Dana Point's adjoining cities include Laguna Beach, Laguna Niguel, San Clemente, and San Juan Capistrano.

Dana Point is located midway between the cities of San Diego and Los Angeles in the southern portion of Orange County. This location provides access to four major airports within about one hour's drive. The San Diego Freeway runs through the City from north to south and Pacific Coast Highway provides intercity access to the beach communities of Orange County. The Orange County Transportation Authority provides public bus service to all of Orange County. Local train service is provided within five minutes of most residents via Amtrak (San Juan Capistrano) and Metrolink (San Clemente).

Dana Point Harbor provides slips and mooring for over 2,500 boats along with over 50 specialty shops and restaurants. The Harbor attracts thousands of visitors annually for shopping, sportfishing, walking, bicycling, parasailing and a whole host of recreational activities. The Harbor is also home to the Ocean Institute, a nationally recognized research and teaching facility dedicated to the protection of the marine environment.

Dana Point Harbor is the gateway to Doheny State Park, one of California's most popular beach facilities. The 62-acre State Park offers camping, picnicking, swimming, surfing, bicycling, tidepool exploration and more.

Dana Point provides over 1,835 hotel rooms ranging in accommodations and services from economy hotels to the five diamond Ritz Carlton and St. Regis Monarch Beach Resort & Spa, the Laguna Cliffs Marriott Resort & Spa and the Doubletree Guest Suites. Entered into at San Clemente, California , 2007, between Beach Road Realty (herein after referred to as ABRR@) and ______ (herein after referred to as AClient@), agree as follows:

1. PROPERTY: BRR rents to Client and Client rents from BRR the real property and improvements described as: 35119 Beach Road, lower level unit, Dana Point, California 92624 (APremises@). The following personal property is included: See attached list shown as AExhibit A@.

2. RELATIONSHIP OF PARTIES: It is specifically agreed and understood that the relationship between the parties herein shall be deemed to be of proprietor and lodger or Guest as opposed to a relationship of landlord/tenant. Guest specifically waives and makes inapplicable to this lodging the provisions of California Civil Code Section entitled “Hiring of Real Property” as set forth in CC 1940-1945 et seq., and further specifically waives and makes inapplicable CCP 1159 re: forcible entry. ____Initial

3. FEES:

A. RENT:
(1) TERM: Client agrees to pay rent at the rate of $ . The term begins on _____, 2007 (ACommencement Date@) at 3 p.m., as a lease ending , 2007, at 10 a.m. with a total rent of $____.

(2) PAYMENT: The rent shall be paid to Beach Road Realty at 501 N. El Camino Real, Suite 200 San Clemente, CA 92672.

B. SECURITY DEPOSIT: $0.00 shall be given by Client as a security deposit. BRR may use all or any portion of the security deposit as reasonably necessary to: (a) cure Client=s default in payment of rent or other sums due; (b) repair damages caused by Client, or by a guest, invitee, or a licensee of Client; (c) clean the Premises if necessary, upon termination of tenancy; and (d) replace or return personal property or appurtenances, excluding ordinary wear and tear. If used during tenancy, Client agrees to reinstate the total security deposit within 24 hours after written notice delivered to Client in person or by mail. No later than eight weeks after Client vacates the Premises, BRR shall furnish to Client an itemized written statement of the basis for, and the amount of , any security received and the disposition of the security, and shall return any remaining portion of the security to Client. The return of the security deposit at the end of the tenancy, if otherwise due, will be handled directly between Landlord and Client and will not involve any broker who releases the security deposit to Landlord. Landlord and Client each indemnify and release any broker from any liability relating to return of the security deposit.

C. Any and all fees referred to hereunder, shall be paid in full, without exception, no later than 60 days prior to the Commencement Date listed in paragraph 3.A.(1) and 3.B. above.

4. CANCELLATION BY TENANT: In the event of cancellation of all or part of the reservation by Client, BRR agrees to refund the rental deposits to guest if and only if the property is re-rented to another quality Client for the canceled period under substantially the same terms and conditions as included herein. In the event of the foregoing, any refund will be less 20% which shall be retained as a cancellation fee. BRR and Client shall make their respective best efforts to re-rent in event of cancellation by Client.

5. UTILITIES: BRR agrees to pay for all utilities-excluding telephone and pay per view movies; however any amount attributable to use in excess of a reasonable amount will be charged to Client (i.e. water). It is agreed that we may charge the credit card on file for this amount. Note: Telephone provided only for local and non operator assisted calls.

6. OCCUPANTS: The Premises are for the sole use as a personal vacation residence by the following named persons only: ______________________________________. If any other persons are found to be engaged in use of residence for the period of use described herein, the lease shall be void and all deposits and rent shall be retained by Landlord. _____Initial

7. PETS: Pets are expressly and absolutely forbidden by the terms of this Rental Agreement. If any pet is brought on the rental Premises, this rental agreement may be forfeited and terminated at the option of BRR. For all other purposes, keeping a pet will be deemed a breach of material covenant of this Rental Agreement and all monies retained without a refund. ____Initial

8. RULES/REGULATIONS: Client agrees to comply with all covenants, conditions, and restrictions, bylaws, rules, regulations, and decisions of Owners= association. Client shall pay any fines or charges imposed by Owners= association, other authorities, due to any violation by Client, or the guests or licensees of Client. Client shall not disturb, annoy, endanger, or interfere with other tenants of the building or neighbors, or use the Premises for any unlawful purposes, including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband, or violate any ordinance, or commit waste or a nuisance upon or about the Premises. Client is expressly prohibited from using the adjoining beach front or adjacent beach areas for beach fires. Client and daytime guests of Client are expressly restricted to parking any and all motor vehicles and/or other parked property, in the designated parking spaces for said leased premises only. Note: PARKING FOR UNIT IS IN THE DRIVEWAY - SIX SPACES. Note: Smoking is not permitted inside the premises at any time. If there is evidence that smoking took place then guest will be charged a minimum $350.00 deep cleaning fee. _____Initial

9. MAINTENANCE/DAMAGE/INSURANCE: Client shall properly use, operate, and safeguard the Premises, all furniture, furnishings, and appliances, and all electrical, gas, and plumbing fixtures, and shall keep them as clean and sanitary as their condition permits. Client shall immediately notify BRR of any damage, and shall pay for all repairs or replacements caused by Client, or the guests or invitees of Client, excluding ordinary wear and tear. It is agreed that we may charge the credit card on file for this amount. Client=s personal property is not insured by BRR. ____Initial

10. ALTERATIONS: Client shall not paint, wallpaper, add or change locks, or make any other alterations to the Premises without BRR=s prior written consent. All furniture must be returned to its original location on guest’s departure or we will make an additional charge, Client acknowledges receipt of:
1 (One) key to Premises upon receipt of Premises
Key Replacement Fee is approximately $150.00 (i.e. cost of re-key and duplicate keys). ____Initial

11. LIMITATION OF LIABILITY:

(a) THIS LEASE IS MADE UPON THE EXPRESS CONDITION THAT BRR SHALL BE FREE FROM ALL LIABILITY AND CLAIM FOR DAMAGES EXCEPT THOSE CAUSED BY THE GROSS NEGLIGENCE OF BRR, by reason of any injury to any person or persons, including Client, or property of any kind, from any cause or causes, in any way connected with the said Premises, or services provided therein, or the use or occupancy thereof during the term of this Lease or any extensions hereof or any occupancy hereunder, in no event shall BRR be liable for any damages from among other things, fire, water, leaking or overflowing of plumbing, theft, or vandalism. In no event shall BRR be liable for any conduct of any other client of BRR or Client of the building where the Premises are located and any such conduct shall not give Client the right to terminate this Lease or any other agreement between BRR and Client. BRR shall not be liable under any circumstances for consequential damages or damages or injury to Client=s business or potential business, no matter what causes such damages. Client and guests will not smoke in the premises.

(b) THE PREMISES AND ANY SERVICES, FURNISHINGS, AND FACILITIES PROVIDED PURSUANT TO THIS LEASE ARE FURNISHED WITHOUT WARRANTY OF ANY SORT WHATSOEVER. Client sole remedy, and BRR sole obligation for any failure to render any service, furnishings or facility, any error or omission, any delay or interruption with respect thereto, is limited to an adjustment to Client=s billing in an amount equal to the charge for such service, furnishing or facility for the periods during which the failure, delay or interruption continues. (By way of example only, if Client=s unit is reasonably determined to be unusable due to the negligence or fault of BRR, Client=s billing will be reduced in proportion to Client=s reduced use thereof.) With the sole exception of the remedy set forth in this paragraph (12b), Client expressly and specifically agrees to waive, and agrees not to make any claim for damages, direct or consequential, arising out of any failure to furnish any service, furnishing or facility, any error or omission with respect thereto, or any delay or interruption of the same. Notwithstanding anything in this paragraph, there shall be no billing adjustment if Client is in default hereunder or if there is a beach closure as determined by the Orange County Healthcare Agency. _____Initial

12. INDEMNITY: CLIENT hereby covenants and agrees to indemnify and hold harmless BRR from all liability, loss, cost or obligations including actual attorney=s fees on account of Client=s use of the Premises and anything done or allowed to be done by Client on the Premises or the building where the Premises are located.

13. ENTRY: Client shall make the Premises available to BRR, authorized agent, or representative, for the purpose of entering to make necessary or agreed services, or to show the Premises to prospective or actual purchasers, tenants, mortgagees, lenders, appraisers, or contractors. BRR and Client agree that four hours notice (oral or written), rendered at the leased premises, shall be reasonable and sufficient notice. In an emergency including without limitation, inspection relating to breach of any of the provisions hereunder, BRR, may enter the Premises, at any time, without prior notice.

14. SALE OF PROPERTY: It is understood by all parties that if the Premises herein mentioned are ever sold to Client and/or any person who would not have been made aware of this property but for the fact of this rental, Beach Road Realty is entitled to a 6 % sales commission based upon the sale price. Furthermore if this property is sold all monies collected for this rental will be refunded upon close of escrow and this agreement cancelled.

15. ASSIGNMENT/ SUBLETTING: Client shall not let or sublet all or any part of the Premises, or assign this Agreement or any interest in it. Any assignment, letting, or subletting that violates this paragraph shall be void. BRR=s acceptance of rent from any person other than the named Client shall not be construed as a waiver of this paragraph.

16. POSSESSION: If Client abandons or vacates the Premises, BRR may terminate this Agreement and regain lawful possession. If BRR is unable to deliver possession of the Premises on the Commencement Date, the Commencement Date shall be extended to the date on which possession is made available to Client. If BRR is unable to deliver possession within one calendar day after the agreed Commencement Date, Client may terminate this Agreement by giving written notice to BRR at the foretasted business address, and shall receive a refund of all rent and security deposit paid. If BRR is unable to deliver possession of the premises to Client at the commencement date of the term, BRR will not be liable for any resulting or consequential damage relating thereto.

17. HOLDING OVER: Because of the nature of BRR=s business (short-term winter and summer recreational rentals), Client understands and is hereby put on notice, that any unauthorized Aholding over@ of the property past the stated rental period could severely jeopardize BRR business and cause loss of rental income from other previously booked Clients, temporary and/or permanent loss of business, goodwill and reputation; and among other things, could force BRR to breach an agreement with similar short term summer and winter recreational Client(s) who may have reservations during Clients unauthorized Aholding over@ period. In this event, Client may be legally liable in damages to said other Clients. Clients should be aware that unauthorized Aholding over@ has been construed as a factor in establishing Amalicious continuing occupation@ of rental property which may entitle Client to treble damages in any unlawful detainer action. Client also recognizes the unauthorized A holding over@ could be grounds in court as a cause of action for intentionally interfering with BRR prospective business advantage. This paragraph shall not be construed as an attempt to define, limit, or liquidate BRR=s potential damages in thereof any breach of the provisions in this agreement. We will also charge $100.00 per hour for each hour that you hold over in the premises. It is agreed that we may charge the credit card on file for this amount.

18. REMEDIES: In the event of a default to the Rental Agreement, particularly, but not limited to Guests unauthorized "holding over" or those acts mentioned above in this agreement, and in addition to all other rights and remedies Landlord may have at law, Landlord shall have the option, upon written notice or as the Law may hereinafter provide, Owner or Company may immediately re-enter and remove all persons and property from premises. In such an instance, the Rental Agreement will be terminated, and Landlord shall be entitled to otherwise recover all damages allowable under the Law. The Guest, as part of the considerations of this special rental, in recognition that this property is booked in advance by other Guests throughout the year, hereby waives all claims for damages that might be caused by Owner/Company; re-entry and taking possession of premises or removing or storing furniture and property as herein provided, and will hold Owner/Company harmless from loss, costs and damages occasioned thereof, and no such re-entry shall be considered or construed to be a forcible entry as defined in the California Code of Civil Procedure or other similar statutory provisions.

19. ATTORNEY=S FEES: In any action or proceeding arising out of this Agreement, the prevailing party shall be entitled to reasonable attorney=s fees and costs.

20. WAIVER: The waiver of any breach shall not be construed as a continuing waiver of the same or any subsequent breach.

21. NOTICE: Notices to BRR may be served at 501 N. El Camino Real, Suite 200, San Clemente, CA 92672.

22. CHILD PROOFING: We understand that no special efforts have been made to AChild Proof@ this house, and accept the risk or harm to any children we allow on the property. These risks are not limited to, but include access to the ocean, adjacent street, railroad tracks across the street, hot tub, cleaning supplies in the house, and plants in the house, patio, and on the street such as oleanders that might be poisonous if ingested. _____ Initial

23. HOT TUB / JACUZZI: If your rental has a hot tub we will do our best to keep it operational; however, we cannot guarantee the operation of a hot tub. It is guest’s responsibility to inspect on arrival and prior to each use that it is clean and sanitary as we will only clean prior to your arrival. Guest will use under their own supervision and at their own risk as there is no lifeguard on duty. Guest will keep the cover closed and locked when not in use.

24. CLEANING: This unit does not include cleaning in the rent. Please note that the cleaning fee does not include dishes or any other additional cleaning required to leave the premises habitable for another occupant. In the event that extra cleaning is necessary, Client will be charged and liable for any additional charges incurred thereby. If excessive cleaning is required after you leave, it will be charged to you. It is agreed that we may charge the credit card on file for this amount. Should client leave any items behind we will retrieve and forward at the cost of shipping and handling plus a $15.00 fee. Note: THERE IS A CLEANING FEE OF APPROXIMATELY $150.00 FOR THIS UNIT.

25. JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one Client, each one shall be individually and completely responsible for the performance of all obligations of Client under this Agreement individually and jointly with every other Client.

26. CLIENT REPRESENTATIONS; CREDIT: Client warrants that all statements in Client=s rental application are accurate. Client authorizes BRR to obtain Client=s credit report at the time of the application and periodically during the tenancy, in connection with approval, modification, or enforcement of this Agreement. BRR may cancel this agreement, (a) before occupancy begins, upon disapproval of the credit report(s), or (b) at any time upon discovering that information in Client=s application is false. A negative credit report reflecting on Client=s record may be submitted to a credit reporting agency if Client fails to fulfill the terms of payment and other obligations under this Agreement. All returned checks are charged a $15.00 fee.

27. ENTIRE CONTRACT: Time is of the essence. All prior agreements between BRR and Client are incorporated in this Agreement.

28. AGENCY CONFIRMATION: The following agency relationship(s) are hereby confirmed for this transaction: BEACH ROAD REALTY is the agent of both the Client and the Landlord. Any potential or actual conflict of interest presented by said agency is hereby expressly waived by Client.

29. ACKNOWLEDGMENT: The undersigned have read the foregoing prior to execution and acknowledge receipt of a copy.

Welcome to Beach road. We hope you enjoy your stay. Please understand THIS IS NOT A RESORT and 80% of the homes are for owners use only. As in your neighborhoods, we try to have a peaceful and friendly atmosphere. Our Board of Directors has established Ordinances by which we run our community. Listed below are a few that are MOST IMPORTANT. Please join us in following these for everyone’s safety and enjoyment.

1. Speed limit is 15 MPH. Radar and patrol enforced. TICKETS SENT TO MUNICIPAL COURT. PEDESTRIANS ALWAYS HAVE THE RIGHT AWAY HERE. SLOW your speed when pedestrians are present. YIELD TO OUTGOING TRAFFIC.

2. PARK ONLY in the spaces behind your home and within the white lines. Park over the white line or in the wrong area and you will be CITED OR TOWED. Ask security guards where to park extra or over-sized vehicles (949-496-1611). We have an area just for this purpose so we ask that you not intrude on your neighbors.

3. NO FIREWORKS PERMITTED as per city code. O.C. SHERIFF will be called. Homeowner or renter is responsible for their guests. All citations and fines will be their burden. Photos and videos are used.

4. BONFIRES must be in a cement ring or metal container 30 ft. from any structure. You must put out your fire if neighbors complain of smoke. Driftwood and debris off the beach burns very smoky. Citations will be issued for non compliance.

5. DOGS ARE NEVER ALLOWED OFF LEASH ON THE BEACH OR ON THE ROAD. You must always pick up after your dog. NEVER BURY DROPPINGS IN THE SAND.

6. ALL TRASH must be bagged and placed in YOUR OWN TRASH CONTAINERS. If your containers are full, please notify our District Manager (949-496-6576). NEVER USE NEIGHBORS TRASH CANS.

7. NO PARKING OF RV’S, MOTOR HOMES, TRAVEL TRAILERS on the street. Some are allowed for 72 hours in the RR parking area. Call security for permission (949-496-1611).

8. NO MOTORIZED SCOOTERS, MINI-MOTORBIKES OR OFF ROAD VEHICLES ALLOWED. California vehicle codes apply here and drivers’ licenses will be asked for. We reserve the right to confiscate all illegally operated vehicles or scooters (released to parents or police).

9. NO JET SKIS WITHIN 100 YDS. OF BEACH. Harbor Patrol will be called and they will issue CITATIONS. Photos and videos are used as evidence.

10. EACH HOME OWNS THE SAND IN FRONT OF THEIR HOUSE. This may vary from 15 ft. to over 100 ft. Please respect this private property as you would want others to respect yours at your home.

11. YOUR GUESTS must have your name and address. We will refuse entrance until you call and have them placed on your guest list. Always call security with guests names and your address. Security will not call you to verify if a guest is to be admitted (949-496-1611).

12. EMERGENCY SITUATIONS. Beach Road Security phone no. is 949-496-1611. You may also call the OC Sheriff at 911. These organizations issue citations for all violations here as they do in any city.
